UK Shipping for none Restricted items.

We use several shipping methods – where possible this includes tracking & must be signed for on delivery.
INSURANCE OVER AND ABOVE THE STANDARD LEVELS PROVIDED BY COURIERS IS AVAILABLE. IF YOU WANT THE ADDITIONAL PEACE OF MIND YOU MUST REQUEST FULL INSURANCE COVER BEFORE DISPATCH. IT MUST ALSO COVER THE FULL COST OF ANY ITEM NOT FULLY INDEMNIFIED UNDER THOSE STANDARD LEVELS. PAID FOR IN FULL BEFORE DISPATCH.
IT IS YOUR RESPONSIBILITY TO REQUEST ANY SUCH ADDITIONAL COVER.

For none restricted items we ONLY ship direct to the PAYMENT card holder address. This is to comply with fraud prevention guidelines. For restricted items such as Air Rifles, Pistols, Shotguns (Section 2), Knives and Rifles (Section 1 Firearms) the following applies; We are happy to arrange shipping to your local Registered Firearms Dealer. These transactions / collections MUST be face to face. As required by UK Firearms Law.

Due to certain size, weight and item restrictions from shipping / delivery companies the following applies:. Shipping method may change prior to sending. Prices agreed and paid before items leave. We will attempt to find the best service to suite your requirements at the lowest cost possible.

All shipping methods require a signature on delivery unless agreed. Delivery on a specific day to suit may be possible. Tell us when ordering and We WILL TRY to arrange this. Once dispatched delivery is out of our control. We can accept no responsibility or liability for late OR none delivery.

UK Courier Delivery – Normally next working day, but can take up to five working days. Our courier shipment option, usually but not exclusively via Parcel Force and / or Royal Mail. Parcel Force is generally by far the best value for large and / or heavy items. Also the only option for guns.

Royal Mail prohibits certain items. Aerosols, Explosives and Knives etc. included. Items will ship by other courier if possible. However they must still comply with their terms of transport. You will need to satisfy yourself you are happy with such terms. Please access direct with that company.

UK Shipping for Restricted items,

IF YOU REQUIRE INSURANCE IT IS YOUR RESPONSIBILITY TO INSTRUCT / ADVISE US.
This can be provided at additional delivery cost and starts at £6 for £500 cover. Subsequently increasing in £500 units at £6 / £500 up to a maximum of £2500 value (£30). Quotations for Higher value levels are available.

Police Licensing Departments insist We follow the ‘letter of the law’. As such your certificate/s and Legislation DOES stipulate that the SELLER of a gun must endorse the BUYERS certificate.
In the past the dealer selling would send a gun on to a fellow trader close to the buyer. They would endorse your certificate and notify their relevant police authority.

THIS IS NO LONGER ACCEPTABLE.

In practice you are now required to send your certificate to me.  (Hopefully with a self-addressed envelope with whatever delivery option you prefer IF sending that back separately). USUALLY I return the certificate with the gun. I still go through the same procedure to get the rifle to your local dealer. You then collect your certificate, suitably endorsed along with the gun/s. DO NOT FORGET to send in YOUR purchase notification to your Licensing Authority.

For gun purchases we WILL generally email a copy of our Form 11 Notification.

You can simply forward this on. Copy / paste the police email address and add your confirmation of the details etc. Leave or delete any details from me/us and send. You SHOULD receive an automated receipt back from the police within a couple of minutes.

My advice is to open a dedicated email folder. Drag any and all emails relating to purchases and sales into that. You then have an EASY access and dedicated record of ALL transactions should the need ever arise.

With a PRE USED gun you are welcome to try it …. Just DON’T go mad! Half a round of clays with a shotgun. Two or three, 3 or 5 round groups, through a rifle should be more than sufficient. If not as described, suitable or you do not like it let me know within the week / 10 days. It can come back, no problem (see next para).

Provided goods arrive back here in the same or better condition they left I am happy to do a refund. Delivery charges and ANY administration costs at your expense. ANY repairs, cleaning or work required IS chargeable and deducted from any refund.

International Shipping

We are happy to arrange International Shipping. Any and all items including firearms to any country permitted under UK law at that particular time. Note: Should The UK Government impose any restriction or embargo during this process we accept no responsibility or liability. The same applies to any other Government. ANY loss occurring under such circumstance is beyond our control. No claim/s accepted. Our preferred International Shipping Agent insists upon FULL cover insurance. This is currently 1% value of goods with a Minimum of £35.

Delivery times will vary depending on location, available options and the item/s. Options advised and paid for prior to dispatch. Always offered and accepted as estimates only. Once dispatched we have no control or responsibility over a delivery.

ALL GOODS

1/ Eligibility for Goods and Services

1 a. By submitting an item order to us, you warrant and represent to us that you are over 18 years old. WHERE THIS IS A LEGAL REQUIREMENT THAT YOU HAVE OR WILL APPLY FOR RELEVANT PERMISSION TO PURCHASE ANY RESTRICTED ITEM.

1 b.  If you are not able or not willing to give the warranties and representations set out in clause 1.a above:. You must not submit an order to us. PLEASE BE AWARE:. YOU commit CRIMINAL OFFENCE just attempting to purchase prohibited items such as a gun without Legal Authority to do so. Unless you have specific permission to make the purchase PLEASE do not do so.

1 c. It IS perfectly acceptable to secure a prohibited item with a suitable deposit which we are happy to accept. The item then held while permission is sought / granted. PLEASE call for clarification if unsure as I am HAPPY to offer advice and help.

2/ Product Information

2 a. We make and take all reasonable efforts to accurately display all Goods for Sale on Our Website. Depending on conditions SOME minor ‘tidying up’ of images is required. This IS kept to minimum as we TRY to advertise as accurately as possible. However you acknowledge and accept that designs, colours, shapes and patterns shown on the Website are approximate only. Colours in particular may differ due to your own computer’s visual settings and hardware.

2 b. Sometimes Goods Ordered are not readily / are no longer available in the colour, design, size or specification requested. We will notify you of the colours, designs or sizes that are currently available. Should you not wish to accept an alternative product you may cancel your order & no charge will be made.

2 c. You acknowledge the following:. You do not rely on any representation and / or warranty not expressly made in accordance with these Terms.

2 d. We offer no guarantee that any particular item or product will always be available.

3. Price and Payment.

3 a. All prices are in UK Pounds Sterling. Payment is only acceptable in this currency. If you do not hold an account in UK Pounds Sterling you can make payment by the following methods; Bank Transfer, Credit or Debit Card and even CASH. Any and all currency conversion fees and costs are covered by you. Furthermore any final fee received by us matches any agreed price for goods and / or services required.

Card Purchases online or by phone have details passed to our Secure Payment Processing Operator. This is currently WorldPay (or whoever we have contract with at the time of order). We process orders using FULLY SECURE systems. FULLY COMPLIANT with Payment Card Industry Data Security Standard (PCI DSS). Fraud prevention measures are in use and We do not store any cardholder data. We destroy all details immediately payment is confirmed.

We hold no details of any automatic / electronic / direct card payments. All card payment information is destroyed immediately once payment is processed.

3 a. 1. The price payable for the Goods shall be as shown on the Website where possible. Prices advertised on the Website include (where applicable) United Kingdom VAT at the current rate. (VAT stands for Value Added Tax). These / any prices exclude postage, packing, insurance and any applicable export duties. Delivery charges advised and agreed separately when ordering. Full payment in advance, before dispatch. Where regulations allow we are happy to supply invoices to reclaim any VAT included. OR supply at the net cost where export rules allow.

3 a. 2. You can make payment by any of the means specified on the Website or otherwise agreed. Payment deemed to be received only with cleared funds showing. Those funds in respect of the full amount stated in the Order including any transport / shipping / delivery charges.

3 a. 3. Prices and or specification are subject to change without notice. Should a change occur on your order, we will notify you of the change. You can then choose to continue with your order or cancel. Provided no fees or charges are levied upon us no charge will be made upon cancellation.

PRE USED GOODS.

3 b. 1. The price payable for the Pre Used Goods shall be as shown and detailed on the Website. Prices advertised on the Website include (where applicable) United Kingdom VAT at the current rate. (VAT stands for Value Added Tax and is currently 20%).

PLEASE NOTE;  IN GENERAL most  (PRE USED) items DO NOT include ANY ELEMENT OF RECLAIMABLE VAT. ALL prices exclude postage, packing, insurance and any applicable export duties. Delivery charges advised and agreed with order and also paid in advance, before dispatch. Where regulations allow we are happy to supply invoices to reclaim any VAT included. OR supply at the net cost where export rules allow.

3 b. 2. Any and all payment/s made only by the means specified on the Website or otherwise agreed. It shall not be deemed to be made until We are in receipt of cleared funds. Those funds in respect of the full amount stated in the Order including any transport / shipping / delivery charges.

4. Right to Cancel or Return.

4 a. You may cancel or return your order at any time up to the fourteenth (14) Day from receipt. New items PROVIDED THAT those Goods remain unopened and sealed in their original packaging. Pre-used Goods must be as when originally sent. ANY and ALL MUST arrive back in re-saleable condition for us to consider and make a refund.

4 b. To cancel your order you must notify us in writing of such intention (which includes letter or email). The sum debited to us from your credit, debit card or bank will be credited to the same source. This within 30 days of your cancellation notice. ALL providing goods are returned as per clause 4.c. below. But EXCLUDING ANY shipping and ANY administration costs. Unless the item/s is / are not as described, or faulty.

4 c. Return The Goods in question to us within 14 days of your cancellation notice. We MUST receive them back in the saleable condition they were when dispatched by us. We accept no claim for goods damaged in transit and not insured whilst in transit. ANY such loss will be at the buyers expense. You MUST Return NEW GOODS unopened and sealed in their original undamaged packaging. In a condition suitable for re-sale. Pre-used goods must be in their original condition as when sent. We are entitled to charge and recover any and all direct costs of having to recover the goods from you. We will off set such costs against any amount to be re-credited to you.

5. Cancellation by Us.

5 a. We reserve the right to cancel the Contract if:

5 a. 1. There is insufficient stock to deliver the goods you have ordered;

5 a. 2. We do not deliver to your area or country;

5 a. 3. One or more of the Goods you ordered has incorrect product information, price, and/or description for whatever reason; OR

5 a. 4. We have reason to believe that you will fail to pay for the Goods. Or that you will not comply with these Terms (or any of them).

5 a. 5. We suspect or have reason to believe any goods will NOT be used for their legitimate intended purpose.

6. Delivery of General Goods to you.

6 a. Unless we notify you otherwise:. Once we accept your order we will dispatch the Goods ordered by you within 7 days. Such goods sent to the billing address you give us at the time you make your order. (Subject to fraud prevention guidelines). We will strive to dispatch all goods purchased as soon as possible and before the 7 days, time permitting.

6 b. If any item is out of stock we will contact you to advise expected delivery times. If that is unacceptable, the order may be cancelled without cost. Or amended at your discretion.

6 c. We use the best couriers possible to deliver your goods on time. We are not liable for lost or delayed parcel deliveries.

6 d. Any shortage / missing item/s or damage must be reported to us via email within 24 hours of delivery. PLEASE inspect packaging PRIOR to signature. Make note of any obvious damage on the receipt and get the couriers to acknowledge any such damage. Where possible take photographic evidence of condition WITH the delivery driver. EMmA Custom Rifles are not responsible or liable for any such loss or damage. We will strive to make a successful claim against any courier on your behalf. Always provided the value justifies the time and effort required. Alternatively we can issue a statement authorising you to act on our behalf to pursue A PARTICULAR claim. However you MUST use any such statement of authority respectfully at all times. ANY abuse of such authority WILL result in immediate and AUTOMATIC cancellation as well as ANY further assistance.

7. Intellectual Property Rights.

We own absolute ANY AND ALL Intellectual Property Rights connected with this Web Site. Any user/client acknowledges that the content of the information is subject to Copyright. Accordingly any user/client ensures that any information use is solely for their research and/or reference purpose only. NO content what so ever will be copied, reproduced, rebroadcast, republished or commercially exploited in any way. PRIOR written confirmation MAY be available from EMmA Custom Rifles. You MUST request and be granted permission agreed BEFORE use.

7 a. You must not modify in any way any content within this web site. Or use any image, illustration, photograph, video, audio, or any graphics separately from any accompanying text.

7 b. You must not delete or alter any copyright, trademark, or other intellectual property rights notices. This applies to and  from copies of any material on this web site.

7 c. You must not reverse engineer or in any way attempt to steal from this web site. This includes the software code or anything else.

ANY use of this site not expressly permitted by these Terms and Conditions of use is a direct breach. Use of this site not expressly permitted in Terms and Conditions of use MAY violate Copyright, Trademarks and other Laws. ANY such breach or breaches could result in prosecution and claims for substantial damages.

8. Privacy and / or Disclosure of Information to Government Bodies.

8 a. We occasionally receive requests to provide information to government bodies. (Including but without limit the Police). This with regards to any Goods you purchase from Us. You hereby consent to Us supplying such information.

8 b. The Law requires We retain contact details as well as full certificate details for any and all gun transactions. We will NOT disclose ANY details to any third party other than if required to do so by law. We implement and maintain reasonable procedures to protect any and all personal information in compliance with applicable law.

9. Liability and Limitation

9 a. If we do not despatch. Or the Goods we deliver are not what you ordered. Have damage or defect on delivery or during the Warranty Period. The delivery is of an incorrect quantity. THEN Our only obligation will be, at Our option and discretion to:.

9 a. 1. Make good any shortage or non-delivery or incorrect delivery;. Or

9 a. 2. Replace or repair any Goods that are damaged or defective;. Or

9 a. 3. Refund the amount paid by you for the Goods in question. (As soon as those goods are returned and arrive here. Inspected and checked).
The above obligations shall not apply in the following circumstances; When such damage or defect has arisen as a consequence of any negligence by you. Or your failure to comply with any reasonable instructions issued by us. Also similar compliance of the same from the manufacturer in respect of maintenance and/or safe handling and use.

9 b. We shall have no Liability to you for any consequential, special or indirect losses. This including without limit loss of revenues, profits, contracts, business or anticipated savings. In addition any damage to or loss of goodwill, reputation or data.

9 c. Without prejudice to the foregoing, our total aggregate Liability to you under and/or arising in relation to this Contract:. ANY figure / fee shall not exceed the amount paid by you for the Goods.

9 d. Nothing in this Contract shall exclude or limit Our Liability for death or personal injury due to Our negligence. Or any Liability which is due to Our fraud. Nor any other Liability We are not permitted to exclude or limit as a matter of law.

9 e. Nothing in this Contract shall exclude or limit your statutory rights.

10. Notices.

11. Events beyond Our control.

We shall have no liability to you for any failure to deliver Goods you have ordered. Or for any delay in doing so. For any damage or defect to Goods delivered if caused by any event or circumstance beyond Our reasonable control. This including, without limitation, strikes, lock-outs and other industrial disputes. Breakdown of systems or network access, flood, fire, explosion, accident or any other reason supplied by an involved third party.

12. Pre Used Products.

Our pre used products come complete with a week’s trial. If you are not satisfied return the goods but you must let us know. Provided they arrive here in the same condition as when sent We will refund the cost of the product. Unfortunately We do not refund the cost of postage. If your product breaks** during the first three months from the date it was received:. You may return it to us for free repair excluding any postage costs to or from us.
**The three months warranty does not cover mis-use, fair wear & tear, poor maintenance or any reasonably accepted perishable.

13.  Miscellaneous.

13 a. If any Terms detailed are unenforceable (including any provision in which we exclude Our liability to you) the following applies:. The enforceability of any other part of these Terms and C0nditions are not affected.

13 b. This Contract will be governed by and interpreted in accordance with English Law. BOTH parties submit to the exclusive jurisdiction of the English Courts.

13 c. Special offers may have terms in addition to those terms listed here. We will display these terms with the corresponding special offer.

13 d. We may revise these terms at any time. To better reflect any changes to Law, Regulatory requirements or to offer improvement and / or enhancements to our services. Should any change have effect on a transaction already underway:. We will be advise and offer opportunity to continue and complete under the old terms. Or decline that transaction (at no cost to yourself).

As a final note PLEASE bear in mind the details above, especially in regard to copyright. These Terms and Conditions have taken a LONG time to produce. On my SEO programme it scores an Amber Light for optimisation with Green for ease of reading.

IF you want to use this entirely OR as a starting point for your own ALL I ASK is;

A/. You request and receive confirmed permission prior to doing so.

B/. Send in a REASONABLE donation for me to pass on to a Registered Charity. Preferably one of your choice with it named on a cheque. Alternatively supply proof of such donation.                                               Ultimately you CAN off set any such donation against your annual income tax. Given that fact, it IS money that actually costs you NOTHING to donate / give up.

By ‘REASONABLE’ I suggest circa £250. If you consider that a lot please sit down and try to write something out for yourself. Pretty sure you WILL quickly have a re-think! As said, its a Taxable Write Off anyway. NOT me asking for money for myself. If you cannot afford £250 then it IS a pretty CLEAR case for NOT starting in business. Go and get a job as you WILL be far better off.
